TOURIST DWELLING RENTAL CONTRACT CONDITIONS

The customer accepts the following conditions for occupation of the tourist dwelling for the period, amount and occupants under this contract, and is aware that in case of any violation of these rules, the company reserves the right to take necessary measures so that the general interest prevails.

1. Behaviour

The guest assumes responsibility for maintaining the apartment, furniture and fittings as they were found on arrival and promises to leave them in the same condition on check-out.

All the occupants of the apartment promise to behave respectfully towards their neighbours, and refrain from any activity (such as annoying noise, music at inappropriate volumes, parties) which can induce complaints from nearby guests and other neighbours. Rest hours are from 22:00h to 9:00h Mon-Fri and 23:00h to 10:00h on weekends and bank holidays.

Noise detectors have been installed in the apartment, which allow us to know whether there is an excess of noise. These devices do not record conversations, they just measure the level of noise.  Any noise disturbance can be fined and even lead to expulsion from the apartment. In case of excessive noise, the guest will be notified by phone number he/she provided in the rental contract. If the excessive noise persists 15 minutes later, making it necessary for us to warn the guest for the second time, we will impose a fine of 200€. In addition, in case that our night concierge needs to come to stop the noise from the apartment because previous warnings were ignored, the guest will be charged for the expenses of the intervention, which amount to 150 €. The guest will be asked to vacate the apartment immediately without refund or redress, should the police be called to the apartment due to complaints about noise late at night.

2. Check-out and check-in hours

Check in: Once the guest has confirmed the reservation, he/she will receive a copy of this contract, a request to send the IDs/passports of all the occupants and finally the codes to enter the building and retrieve the keys to the apartment from a safe box. The guest may check into the apartment from 15:00h on the date of arrival. At that time the reservation holder must hand in a signed copy of this contract.

Check out: The guest must check-out from the apartment by 11:00h at the latest. Not doing so will imply a penalty of 50 € for every half an hour in which his/her departure is delayed. In case of not returning all sets of keys, a penalty of 3€ will be applied for each missing card.

3. Prohibitions

- The apartment must not be used for purposes other than that for which it has been rented, that is, for living purposes only, as a temporary accommodation while away from their habitual residence.

- Guests may not bring additional people to the rental property without previously informing Deco Apartments. And the maximum occupancy limit of the apartment must be respected.

- Performing any activity that might violate the usual rules of coexistence and disturb the life of the community.

- Throwing a disruptive party, creating a nuisance that disturbs the surrounding neighborhood.

- It is forbidden to bring pets into the apartment.

- Smoking is forbidden inside the apartment and not observing this rule will signify a penalty of 200€. It is only allowed to smoke in the balcony, but taking care to shut the door connecting the balcony to the apartment.

4. Obligations

- The guest is responsible for truthfully stating the number of people which will stay at the apartment. Deco Apartments reserves the right to deny entrance to those people whose presence has not been declared.

- Deco Apartments is obliged by law to declare the identity of each and every person staying in our apartments, in order to submit a traveller’s registry to the authorities. To comply with this, every guest must submit a copy of their Passport or identity card, where their name, surname, nationality, date of birth and document number must be stated.

- The guests commit to close the door with the double lock every time they leaves the apartment, and to place all the valuable items (phones, cash, jewels, etc.) in the safe if they’re not taking them along.

- The guest commits to leave the apartment reasonably clean on departure, without rubbish or leftover food. In case the apartment is left in such a state of untidiness and filth that an extra cleaning is needed, the guest will be asked to pay for the cost of this service.

- The guest promises to pay a deposit of 220, 260€ or 320€ upon arrival (depending which of our buildings you've chosen for your accommodation). The deposit will not be returned if the guest breaches the rules stated in this contract.

- The guest authorizes Decimonónico S.L. to charge to the credit card used to secure the booking a reasonable compensation for any damages that may occur.

- The guest agrees to allow the concierge to enter the apartment in case of emergency or technical problems. If necessary, the concierge may enter without prior notice to the guest.

- The guest agrees that Decimonónico S.L., shall not be liable for any direct or indirect damages that may arise as a consequence of the use of the apartment by the guest, including –but not limited to- any personal damages, losses due to fire, robbery or criminal behavior

Deco Apartments Barcelona reserves the right to annul this contract with immediate effect and without refund of any kind should the rules of coexistence, respect and civility towards neighbours mentioned in this contract be severely violated.
